PLEASE READ THIS TERMS OF USE AGREEMENT (THIS “AGREEMENT”) CAREFULLY. BY USING WWW.THEHAZMATAPP.COM (THE “WEBSITE”OR “SERVICE”) YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

Your access to and use of this Service is conditioned upon your acceptance and compliance with the following terms and conditions set forth in this Agreement. By accessing or using the Website, whether as a guest or as a registered user, you agree to be bound by this Agreement. If you disagree with any part of this Agreement then you must not access or use the Website.  

This Website is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. By using this Website, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

Disclaimer

The Website and the contents contained therein are intended to be used only as guidance in the classification of hazardous materials in accordance with model building/fire codes and National Fire Protection Association (NFPA) standards. The information and hazard classifications contained on the Website represent the sole opinion of HazClass, Inc. doing business as TheHazMatApp (the “Company”) and should not be relied upon by any user of the Website for any purpose. The hazard classifications contained on the Website do not represent the only classification for the specified chemicals and compounds and the Website should be utilized in conjunction with other sources, including licensed professionals, prior to making any decisions involving such chemicals and compounds. The classifications assigned to the chemicals and chemical compounds are based on the Safety Data Sheet (SDS) reviewed at the time of classification.

The data provided on the SDS may vary from by manufacturer or supplier. The Company does not guarantee or warrant that the information provided herein represents the only possible hazard classification for the chemicals listed. Final interpretations and approvals are the responsibility of the Authority Having Jurisdiction (AHJ). The Company shall not be liable for any damages whatsoever resulting from the use of the Website and all users shall ensure that they engage the services of licensed professionals and make their own independent investigation into any matters relating to any chemicals or compounds listed on the Website. By accessing and using the Website, you agree to indemnify and hold the Company harmless from any and all loss, liability costs, and expenses, arising out of the use of the Website.

The Website is intended for users already familiar with the model building/fire codes and classifications. Users should not use this Website as the sole means of chemical classifications. All classifications should be verified, and peer reviewed prior to implementation of any building or fire code requirement and the Company will not be responsible for any user’s failure to verify and obtain such peer review. The information presented on or through the Website is made available solely for general information purposes and we do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

Changes to the Terms of Use

We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter.

Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you.

These Terms of Use permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

-                     Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

The Company name, the terms THEHAZMATAPP, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Website:

-                     In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

-                     For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.

-                     To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

-                     To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).

-                     To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website, or expose them to liability.

Additionally, you agree not to:

-                     Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website.

-                     Use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.

-                     Use any manual process to monitor or copy any of the material on the Website, or for any other purpose not expressly authorized in these Terms of Use, without our prior written consent.

-                     Use any device, software,or routine that interferes with the proper working of the Website.

-                     Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

-                     Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.

-                     Attack the Website via a denial-of-service attack or a distributed denial-of-service attack.

-                     Otherwise attempt to interfere with the proper working of the Website.

Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on an annual basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it, or the Company cancels it. You may cancel your Subscription renewal either through email or by contacting the Company at info@thehazmatapp.com.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide the Company with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize the Company to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, the Company will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Payment processing services for business owners on the Website are provided by Stripe and are subject to the Stripe Services Agreement – United States located at https://stripe.com/ssa, the Stripe Connected Account Agreement located at https://stripe.com/connect-account/legal, and the Stripe Global Privacy Policy – Worldwide (the “Stripe Privacy Policy”) located at https://stripe.com/privacy. By using the Website and making payments through the Website, you agree to be bound by the Stripe Services Agreement and Stripe Privacy Policy, as the same may be modified by Stripe from time to time. As a condition of the Company enabling payment processing services through Stripe, you agree to provide the Company accurate and complete information about you and you authorize the Company to share it and transaction information related to your use of the payment processing services provided by Stripe.

Fee Changes

The Company, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. The Company will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted or denied in the Company’s sole discretion.

Accounts

When you create an account with us, you represent that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account and revocation of right to utilize the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account by contacting privacy@thehazmatapp.com.

Links to Other Websites

Our Service may contain links to third party web sites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for the content,privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms of Use.

All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless the Company and its affiliates, licensees, and licensors, and their respective employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ fees), resulting from or arising out of: (i) your use and access of the Service, by you or any person using your account and password; or (ii) a breach of these Terms of Use.

Limitation of Liability

Governing Law

These Terms of Use shall be governed and construed in accordance with the laws of the state of Nevada, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Nevada, in each case located in the City of Las Vegas and County of Clark, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. These Terms of Use, in conjunction with the Company’s Privacy Policy and other policies referenced therein, constitutes the entire agreement between you and the Company regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to such new material terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
